In 2022, changes to the Australian Consumer Law and the Australian Securities and Investments Commission Act 2001 made the existing unfair contract terms (UCT) protections stronger. The reforms:
improved the range of remedies and enforcement powers
expanded the class of contracts covered
made the law clearer and stronger.
The review will look at how the amended provisions are working. The consultation also seeks views on extending UCT protections to all franchisees.
The UCT provisions protect consumers and small businesses from unfair terms in standard form contracts.
